What makes a product "defective?
A product is defective if it is unreasonably dangerous to the user of the
product because of the defective design or inadequate warnings of the dangers
associated with the use of the product.
When am I able to collect damages
for injuries I received from a defective product?
A consumer who is
injured by a defective product has a right to collect damages from the seller
or manufacturer of the product. Injuries from
defective products
often occur at work. If you are injured at work by a defective product,
you are entitled to collect both Workers' Compensation benefits and other
damages
from the seller or manufacturer of the defective product that injures
you. In addition, you may also be able to collect punitive damages.
Toxic exposure
When am I able to collect damages for injuries I received from
exposure to toxic substances?
If you are injured because of exposure to toxic substances, you may
be entitled to recover damages from the seller or manufacturer of
the substance.

of these type injuries occur at work. If you are injured at work
by exposure to a toxic substance, you are entitled to collect both Workers'

substance.

Likewise, companies that contaminate the groundwater with toxic substances are liable for the damages caused, including personal injury, property damage, and punitive damages.
